Terms of Service

These terms are an agreement between you and Michael Blythe, who runs Fencerow ("we" or "us"). By creating an account or using Fencerow, you agree to them. If you don't agree, don't use the service.

Who can use it

You must be at least 18 and located in the United States. Fencerow is offered only in the US. If you use it on behalf of a farm or business, you confirm you're allowed to agree to these terms for it.

Your account

You sign in with a Google account. Keep that account secure; anything done through your Fencerow account is your responsibility. Tell us right away at info@fencerow.farm if you think someone else has used it.

Not financial or agronomic advice

Fencerow is a calculator and record-keeping tool. Breakeven, profit, and ROI figures come from the costs you enter and from USDA NASS data, and rotation and nitrogen credit notes are general rule-of-thumb ranges. None of it is financial, lending, tax, legal, or agronomic advice. Check important decisions with your lender, accountant, extension agent, or agronomist. USDA data can be missing, revised, or late, and we don't control it. This product uses the NASS API but is not endorsed or certified by NASS.

Your data

Everything you enter (farms, fields, costs, plans, and results) stays yours. You give us permission to store and process it only to run the service for you. We don't sell it. See the Privacy Policy for details.

Plans and billing

• The Free plan includes up to 3 fields at no cost.
• Pro costs $49 a year or $5 a month, plus any sales tax that applies.
• Pro is sold through Link, Stripe's checkout service, which acts as the merchant of record for your purchase. Link processes your payment, collects and remits sales tax, sends your receipts, and handles payment questions and disputes. Your card statement will show a charge starting with "LINK.COM*".
• Pro renews automatically at the end of each year or month until you cancel. You can cancel any time from the Billing page or at link.com, and Pro stays active through the period you already paid for.
• We don't offer refunds. We don't give refunds or credits for partial periods or unused time, except where the law requires it. Link's support team may, under its own policies, issue a refund in some cases.
• If a payment fails, Stripe will retry it. If it still can't be collected, your account returns to the Free plan.
• We may change prices or plan limits. Price changes for Pro take effect at your next renewal, and we'll email you at least 30 days before.

If you go back to Free

Your existing fields, plans, and reports stay available to view, edit, and print. You can't add fields beyond the Free limit until you upgrade again.

Acceptable use

Don't:

• try to access other people's accounts or data;
• probe, scan, overload, or disrupt the service;
• use automated tools to scrape it or get around plan limits;
• use it for anything illegal.

Suspension and closing your account

You can stop using Fencerow at any time and delete your account yourself from the Account page, or ask us to by emailing info@fencerow.farm. Deleting your account ends a Pro plan immediately, without a refund for the time left. We may suspend or close an account that breaks these terms. If we shut down the service, we'll give at least 30 days' notice so you can print or copy your records.

No warranty

Fencerow is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose, and accuracy of results. We don't promise the service will be uninterrupted or error-free.

Limit of liability

To the extent the law allows, we aren't liable for indirect, incidental, or consequential damages, or for lost profits, crop losses, or business decisions made using the service. Our total liability for any claim is limited to what you paid us in the 12 months before the claim, or $50 if you're on the Free plan.

Governing law

These terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Arkansas.

Changes to these terms

We may update these terms. If a change is significant, we'll email you or show a notice in the app before it takes effect. Continuing to use Fencerow after that means you accept the updated terms.
